Over Taylor Biggs | News | NHS admits causing the death of a patient who fell from a hospital bed

Mrs A was age 79 when she was admitted to Barnstaple hospital in October 2009 after a routine knee operation.  She became unwell and developed an infection.  She was put in a side room where there were no windows from which to observe her.

One evening in October 2009, a nurse attended upon her and raised the bed.  But she then failed to lower it and ensure that the bedrails were securely fixed in the raised position.  Mrs A was left unattended and unobserved.

Unfortunately, Mrs A then fell from the bed sustaining severe facial injuries and developed an acute subdural haematoma which, sadly, caused her death.

The matter was pursued by Mrs A's estate, represented by Over Taylor Biggs and a letter of claim was sent by specialist clinical negligence solicitor, Paul Atkinson.

The NHS admitted responsibility for the negligence that caused Mrs A untimely death. The claim eventually was settled, with a payment of compensation.

The hospital also instigated a serious untoward incident investigation report.  This made recommendations that hopefully will prevent a similar tragedy recurring.

If there are issues arising out of this or on any other medical matter, please contact Paul Atkinson of our clinical negligence department.
