In Commissioners for Her Majesty's Revenue and Customs v Annabel's (Berkley Square Ltd) and ors 2008, the Employment Appeal Tribunal has held that tips distributed through a ‘tronc' system do not count towards the national minimum wage. The decision has been heralded as a victory for bar and restaurant staff by HMRC.
