Whilst this is good news for businesses using agency staff, it will still be important that businesses can demonstrate that its agency workers are not treated in the same way as employees.  Also, if a business uses a larger number of agency workers then it should consider obtaining an indemnity from the agency in respect of any employment claims which may be brought by the agency workers.
